Kovid-19’un özellikle sağlık çalışanları yönünden meslek hastalığı sayılması için sendikalar tarafından sık sık gündeme getiriliyor. Yine muhalefet partileri de bu konuda hazırladıkları yasa tekliflerine Meclis’e sundu. Ancak bugüne kadar herhangi bir adım gelmedi.

SENDİKA GENELGENİN İPTALİNİ İSTEDİ

HaberTürk’ ten Fevzi Çakır’ın haberine göre; Bağımsız Maden İşçileri Sendikası konuyu yargıya taşıdı. Sendika, Sosyal Güvenlik Kurumu’nun Kovid-19’u meslek hastalığı saymayan genelgesinin yürütmesinin durdurulması ve iptali talebiyle Danıştay’da dava açtı. Dava dilekçesinde; pandemi koşullarında çalışan kişilerin salgına yakalanmaları durumunda iş kazası kapsamına alınmamaların hiçbir izahının olmadığı savunuldu. Mevzuata aykırı olduğu ifade edilen genelgenin iptal edilmesi gerektiği kaydedildi.

Amaç ve kapsam

MADDE 1 – (1) Bu Tebliğin amacı, 7/11/2013 tarihli ve 6502 sayılı Tüketicinin Korunması Hakkında Kanunun 77 nci maddesinde düzenlenmiş olan idari para cezalarının, 28/11/2020 tarihli ve 31318 sayılı Resmî Gazetede yayımlanan Vergi Usul Kanunu Genel Tebliği (Sıra No: 521)’nde 2020 yılı için yeniden değerleme oranı olarak tespit edilen % 9,11 (yüzde dokuz virgül on bir) oranında artırılarak yeniden belirlenmesidir.

CHP Genel Başkan Yardımcısı Gamze Akkuş İlgezdi, cezaevlerinde yaşanan hak ihlalleri her geçen gün daha da artarken her saatte 20 tutuklu ve hükümlünün kötü muameleyle karşılaştığını belirtirken, “Yeni Türkiye’nin yeni yönetim biçimi, kitlesel cezalandırmadan geçiyor” dedi.

T24’te yer alan habere göre, cezaevlerinde son yıllarda hak ihlallerinin hızla arttığına dikkat çeken İlgezdi, raporunda ‘iktidarın sürdürdüğü baskıcı siyasetin izlerine en çok hapishanelerde rastlandığını’ kaydetti. Raporda, Adalet Bakanlığı tarafından açıklanan İnfaz Hâkimliği İş Durumu verilerine işaret edilerek şöyle dendi:

“2010 ve 2019 yıllarında tam 1 milyon 691 bin 131 mahpus, İnfaz Hâkimliklerine başvuru yaptı. Buna göre her saat 20 mahpus, karşılaştığı kötü muameleyi bildirdi.”

Olaylar

Türk Silahlı Kuvvetlerinde (TSK) piyade yüzbaşı olarak görev yapan başvurucu nöbet hizmetlerinde bazı düzenlemeler yapılması talebiyle üst komutanlığına dilekçe ile başvuruda bulunmuştur. İlgili Alay Komutanlığı söz konusu dilekçedeki bazı ifadeler nedeniyle başvurucunun savunmasını istemiştir. Savunmasını vermesini müteakip Alay Komutanlığının kararıyla başvurucu üst amiri tarafından kınama cezası ile cezalandırılmıştır. Başvurucunun anılan cezanın iptal edilmesi talebiyle bir üst amirine yaptığı itiraz, ilgili Tugay Komutanlığının kararıyla reddedilmiştir. Yargıtay 2. Hukuk Dairesi, kendisini çalışmaya zorlayan kocasına, ‘Maaşın düşük, yetersiz para kazanıyorsun’ diyerek hor gören kadını ağır kusurlu saydı. Yüksek Mahkeme, kadının bu sözlerinin kocanın kişisel haklarına saldırı niteliğinde yer aldığına ve tazminat sebebi olduğuna hükmetti.

Geçimsizlik yaşayan çift Aile Mahkemesi’ne müracaat ederek karşılıklı boşanma davası açtı. Davacı erkek, ‘güven sarsıcı davranışlarda bulunmak’la suçladığı eşinin sürekli, ‘Sen yeterli para kazanamıyorsun’ diyerek kendisini hor gördüğünü, küçük düşürdüğünü öne sürdü. Davalı – karşı davacı kadın da eşinin kendisine şiddet uyguladığını öne sürdü. Mahkeme, boşanmaya sebep olan olaylarda davacı kadının tam kusurlu olduğu gerekçesiyle kadının davasının reddine, erkeğin davasının kabulüne ve tarafların boşanmalarına karar verdi. Kadın kararı istinafa götürünce devreye giren Bölge Adliye Mahkemesi, tarafları eşit kusurlu buldu. Bölge Adliye Mahkemesi’nin bu kararını ise davacı koca temyiz edince devreye Yargıtay 2. Türkiye Barolar Birliği Kadın Hukuku Komisyonu ve 77 baro, ortak bir açıklama yaparak, İstanbul Sözleşmesi’nden Cumhurbaşkanı kararıyla çekilmenin Anayasa’ya göre mümkün olmayacağını vurguladı. Açıklamada, İstanbul Sözleşmesi’nin yürürlükte olduğu belirtildi.

Türkiye Barolar Birliği Kadın Hukuku Komisyonu (TÜBAKKOM) ve 77 baro, Türkiye’nin, AKP’li Cumhurbaşkanı Recep Tayyip Erdoğan’ın gece yarısı kararıyla İstanbul Sözleşmesi’nden çekilmesine ilişkin açıklamada bulundu.

“İstanbul Sözleşmesi Yürürlüktedir” başlıklı açıklamada, Meclis’te bütün partilerin oybirliğiyle kanunlaşan İstanbul Sözleşmesi’nin, Anayasa’nın 104’üncü maddesi uyarınca Cumhurbaşkanı tarafından yürürlükten kaldırılamayacağı vurgulandı.

Avukat Mehmet Durakoğlu, İstanbul Barosu Başkanlığı’na üçüncü kez seçilerek güven tazeledi. Resmi olmayan sonuçlara göre 8 bin 503 oy alan Durakoğlu, 2016 yılında 13 bin, 2018 yılında 8 bin avukatın oyunu almıştı.

İstanbul Barosu Genel Kurulu tamamlandı. İstanbul Barosu Başkanlığı’na Önce İlke Çağdaş Avukatlar Grubu’nun adayı avukat Mehmet Durakoğlu üçüncü kez seçildi.

Haliç Kongre Merkezi’nde gerçekleştirilen İstanbul Barosu Başkanlık seçiminde, 52 bin 049 üyesi bulunan Baro’da sadece 26 bin 30 avukat, 131 sandıkta oyunu kullandı.

Kötülüğün sekreteri’ hakim karşısına çıktı

Nazi toplama kampında sekreter olarak görev yapan 96 yaşındaki Irmgard Furchner yargılanacağı dava öncesi kaçma girişiminde bulunmuş ancak polis tarafından yakalanmıştı. ‘Kötülüğün sekreteri’ olarak adlandırılan kadın sonunda hakim karşısına çıktı.

Almanya’da, 1943-1945 yıllarında Stutthof Nazi toplama kampında sekreter olarak görev yapan 96 yaşındaki Irmgard Furchner’ın, 11 binden fazla kişinin öldürülmesine yardım etmekten yargılanacağı dava günlerdir kamuoyu tarafında merakla bekleniyor.

AİHM’den Türkiye’ye tavsiye: Cumhurbaşkanına hakaret suçunu düzenleyen yasa değişsin

Avrupa İnsan Hakları Mahkemesi (AİHM) bugün açıkladığı bir karar ile Türkiye’ye Türk Ceza Kanunu’nun (TCK) 299. maddesini değiştirme tavsiyesinde bulundu. Söz konusu madde, “Cumhurbaşkanına hakaret” suçunu düzenliyor.

AİHM bu tavsiyeyi, Facebook’ta paylaştığı bir fotoğraf ve bir karikatür nedeniyle hükmün açıklanması geri bırakılmış 11 ay 20 günlük bir hapis cezası alan Vedat Şorli’nin başvurusu üzerine verdi.

20 gündür haber alınamayan zabıt katibi her yerde aranıyor!

Bursa Adliyesi’nde 7 yıldır zabıt katibi olarak çalışan Aysen Binici’den (38) 20 gündür haber alınamıyor. Ablasının hayatından endişe ettiğini söyleyen Aytaç Binici (35), “Adliyede yetkililer ile arkadaşlarıyla görüştüm, bir problem yaşamadığını söylediler” dedi.

Bursa Adliyesi’nde 7 yıl önce göreve başlayan, icra müdürlüğü biriminde zabıt katibi olarak çalışan Aysen Binici, 20 gün önce yıllık izne ayrıldı. Yıldırım ilçesi Karamazak Mahallesi’ndeki evinde tek yaşayan Binici’ye cep telefonu ile ulaşamayan yakınları, durumu polise bildirdi. Polis, Binici’yi bulmak için çalışma başlattı.

SAVUNMA HAKKI

Avrupa İnsan Hakları Sözleşmesi’nin (AİHS) 6/3 maddesine göre bir suç ile itham edilen herkes savunma hakkı bağlamında aşağıdaki asgari haklara sahiptir: Kendisine karşı yöneltilen suçlamanın niteliği ve sebebinden en kısa sürede, anladığı bir dilde ve ayrıntılı olarak haberdar edilmek; savunmasını hazırlamak için gerekli zaman ve kolaylıklara sahip olmak; kendisini bizzat savunmak veya seçeceği bir müdafinin yardımından yararlanmak; eğer avukat tutmak için gerekli maddî olanaklardan yoksun ise ve adaletin yerine gelmesi için gerekli görüldüğünde, resen atanacak bir avukatın yardımından ücretsiz olarak yararlanabilmek; iddia tanıklarını sorguya çekmek veya çektirmek, savunma tanıklarının da iddia tanıklarıyla aynı koşullar altında davet edilmelerinin ve dinlenmelerinin sağlanmasını istemek; mahkemede kullanılan dili anlamadığı veya konuşamadığı takdirde bir tercümanın yardımından ücretsiz olarak yararlanmak.
